GAR, LLC (“GAR,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit gar.llc (the “Site”), contact us, or communicate with us by phone, email, or SMS text message. It also describes the privacy rights available to California residents.

1. Scope of This Policy

This Policy applies to personal information we collect through the Site, through forms and calls you submit to us, and through SMS text messaging (see Section 6). It does not apply to third-party websites or services that we do not control, even if linked from our Site.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Identifiers – name, email address, mailing or service address, and phone number you provide through a contact form or call

  • Commercial information – services requested, appointment or field-visit history

  • Internet or network activity – IP address, browser and device type, pages viewed, and similar data collected automatically through cookies and similar technologies (see Section 3)

  • Geolocation data – general location inferred from an IP address or a service address you provide

  • SMS/text messaging data – mobile number, message content, and delivery data when you opt in to text communications (see Section 6)

We collect this information directly from you, automatically through your use of the Site, and from service providers who help us operate the Site.

3. Cookies and Tracking Technologies

The Site uses cookies and similar technologies to operate, secure, and analyze traffic to gar.llc. You can review and adjust your choices at any time using the “Cookie Preferences” link in the footer of this Site. We do not currently use cookies or similar technologies for cross-context behavioral advertising.

4. How We Use Information

We use personal information to:

  • Respond to inquiries and schedule field visits or services

  • Provide crop protection, nutrition, safety, and compliance services

GAR, LLC does not sell personal information, and does not share personal information for cross-context behavioral advertising. We disclose personal information only to:

  • Service providers who help us operate the Site, host data, or deliver SMS communications (see Section 6), under agreements that limit their use of the information to providing services to us

  • Government agencies or other parties when required by law, subpoena, or other legal process

  • A successor entity in connection with a merger, acquisition, or sale of assets

6. SMS Text Messaging

GAR, LLC uses SMS text messaging to communicate with customers, vendors, employees, and other authorized parties. This section explains how we collect, use, store, and protect information associated with SMS communications delivered through our telecommunications provider.

6.1 Information We Collect

When you opt in to receive SMS text messages from GAR, LLC, we may collect:

  • Your mobile phone number

  • Your name (if voluntarily provided or already on file)

  • Message content you send to us

  • Delivery and interaction data (e.g., timestamps, delivery confirmation)

GAR, LLC does not sell or share SMS data with third parties for marketing purposes.

6.2 How We Use SMS Information

We use SMS messaging for legitimate business purposes, including:

  • Service alerts, scheduling updates, and appointment confirmations

  • Account notifications or security verification codes

  • Customer service communications

  • Operations-related updates for employees or contractors

  • Emergency or critical notifications affecting GAR, LLC operations

We will not send marketing or promotional SMS messages without explicit consent.

6.3 Opt-In and Opt-Out

Opt-In – By providing your mobile number to GAR, LLC or replying to an opt-in request, you consent to receive SMS messages from us.

Opt-Out – You may opt out at any time by replying “STOP” to end all SMS communications, or “HELP” for assistance. Opt-out requests are processed immediately, but message delivery may vary by carrier.

6.4 Message Frequency and Fees

Message frequency varies based on your relationship with GAR, LLC. Standard message and data rates may apply depending on your mobile carrier plan. GAR, LLC is not responsible for carrier fees resulting from SMS communication.

6.5 Third-Party Service Provider

GAR, LLC uses a third-party telecommunications provider to send and receive SMS messages. This provider processes SMS data on our behalf, may log metadata required for message routing and regulatory compliance (including TCR/10DLC requirements), and does not use your SMS data for its own marketing or sales purposes.

7. Data Security

We implement appropriate administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or misuse. However, no method of transmission or storage is completely secure. SMS in particular is not guaranteed to be a fully secure communication channel — please avoid sending sensitive information (e.g., passwords, financial data) by text message.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide our services, comply with legal and regulatory requirements, resolve disputes, and enforce our agreements. Retention periods vary by category of information and are based on legal requirements, internal compliance policies, and operational needs. Data is securely deleted or de-identified when it is no longer required.

9. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), may give you the right to:

  • Know what personal information we have collected, used, disclosed, and (if applicable) sold or shared about you in the preceding 12 months

  • Delete personal information we have collected from you, subject to certain exceptions

  • Correct inaccurate personal information

  • Opt out of the sale or sharing of personal information — as noted in Section 5, GAR, LLC does not currently sell or share personal information as those terms are defined by the CCPA

  • Limit the use and disclosure of sensitive personal information

  • Non-discrimination for exercising any of these rights

To submit a request, contact us using the information in Section 13. We will take reasonable steps to verify your identity before responding, and we will respond within the time required by law. You may designate an authorized agent to submit a request on your behalf.

10. Do Not Track

Some browsers offer a “Do Not Track” (DNT) signal. Because there is no common industry standard for responding to DNT signals, our Site does not currently respond to them. California residents may instead exercise the rights described in Section 9.

11. Children’s Privacy

Our Site and services are directed to businesses and adults and are not intended for children under 16. We do not knowingly collect personal information from children.

12. Changes to This Policy

We may update this Policy from time to time. Updates will be posted on gar.llc, and the “Last Updated” date above will be revised accordingly. Material changes will be reflected with a new effective date.
